Terms and Conditions of Entry into Marsh CPA Week Competition ("Competition")

  1. Information on how to enter and prize details form part of these conditions. Entry into the Competition is deemed acceptance of these terms and conditions of entry.
  2. The promoter of this competition is Marsh Pty Ltd (ABN 86 004 651 512 AFS licence number 238 983) of One International Towers, 100 Barangaroo Ave, Sydney NSW 2000, Australia ("Promoter" or “Marsh”).
  3. The Competition will be promoted to the attendees of the CPA Week that will take place from 6 June 2024 to 7 June 2024 in Perth, Western Australia.
  4. Marsh has the permission of CPA Australia Ltd (ABN 64 008 392 452) of 20/28 Freshwater Pl, Southbank VIC 3006 (“CPA”) to run the Competition.
  5. The Marsh CPA Week Competition commences at 12:00pm AWST on Thursday 6th June 2024 and ends at 17:30 AWST on Friday 7th June 2024 ("Competition Period").
  6. Entry is open to Australian residents who are aged 18 years and older with a valid email address (“Eligible Entrant”). Where applicable, all Eligible Entrants will be required to provide proof of eligibility to redeem their prize.
  7. An Eligible Entrant must, during the Competition Period:
    a) submit a completed Business Enquiry Form (“the Form”) online;
    b) accept these Terms and Conditions where required on the Competition landing page online; and
    c) accept and consent to Marsh’s Privacy Notice accessible on the Marsh website via the URL https://www.marsh.com/au/privacy-notice.html where required within the Form to confirm how Marsh (as the Promoter) will collect, hold, use and share your personal information.
    (together an “Eligible Entry”).
  8. A maximum of one (1) Eligible Entry within the Competition Period applies.
  9. The total prize pool value is AUD $500.There will be two (2) individual prizes in total and one winner of each prize. There shall be no bonus prizes awarded and an Eligible Entrant cannot win more than one (1) prize. The prize pool consists of:
    a) Bottle of Dom Perignon Champagne (valued at $300.00; and
    b) Two tickets to a regular season AFL game of choice (valued at $200).
  10. The prizes must be taken as offered and cannot be transferred, exchanged or redeemed for cash. The prize value is the recommended retail price including GST.
  11. Please note, prize tickets are not valid for marquee or high-profile matches including (but not limited to) Anzac Day, Maddie’s Match, Dreamtime at the G, or Grand Finals.
  12. The Competition prize details are correct at the time of publishing these Terms and Conditions.
  13. The winners will be determined at 17:30 AWST on Friday 7th June 2024 . The winners will be determined by way of random selection from the Form’s unique identifiers by the Promoter from the Eligible Entries. Two winners will be chosen by random draw which will take place at Perth Convention and Exhibition Centre 21 Mounts Bay Road, Perth WA 6000. The Promoter will take all reasonable steps to contact the winners as set out below in clause 15.
  14. This is a game of chance and skill plays no part in determining the winners. No purchase of goods or services is required to enter the Competition and the purchase of any goods or services from Marsh or any other entities associated with this Competition will not improve your chance of winning.
  15. The judges' decision (including any decisions as to prize distribution) is final and the Promoter will not enter into correspondence regarding the result. The winners will be notified in person or via telephone (using the telephone number provided at the time of entry) following the completion of the CPA Week on 7th June 2024. If reasonable efforts and attempts to contact the winner(s) are unsuccessful and the prize(s) remain unclaimed by Friday, 14 June 2024, this information will be published, and the prize(s) will be forfeited by the winner(s). An unclaimed prize draw will take place on Friday, 14 June 2024 at Tower 1, Collins Square, 727 Collins Street, Docklands VIC 3008. To claim the prize, the winner(s) must respond to the Promoter in writing by email.
  16. The Promoter and CPA accept no responsibility for any entries not received for any reason during the Competition Period. No responsibility will be taken for lost, late or misdirected entries. The Promoter and CPA are not responsible for technical difficulties with the entry mechanism and does not warrant that the entry mechanism will be available at all times.
  17. Incomplete, illegible, and incorrect entries or entries containing offensive or defamatory comments, or which breach any law or infringe any third-party rights, including intellectual property rights, are not eligible to win.
  18. If this Competition is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law (a) to disqualify any individual; or (b) to modify, suspend, terminate or cancel the Competition, as appropriate.
  19. Nothing in these terms and conditions limits, excludes or modifies or purports to limit, exclude or modify the statutory consumer guarantees as provided under the Competition and Consumer Act 2010 (Cth), as well as any other implied warranties under the Australian Securities and Investment Commissions Act 2001 (Cth) or similar consumer protection laws in the State and Territories of Australia ("Non-Excludable Guarantees"). Except for any liability that cannot by law be excluded, including the Non-Excludable Guarantees, the Promoter and CPA (including their respective officers, employees and agents) exclude all liability (including negligence), for any personal injury, or any loss or damage (including loss of opportunity), whether direct, indirect, special or consequential, arising in any way out of this Competition.
  20. Any Eligible Entrant who, in the opinion of the Promoter, tampers or interferes with the entry mechanism in any way, or who does not properly comply with the entry process, will be ineligible to win.
  21. The Promoter and CPA reserve the right to disqualify entries in the event of non-compliance with these terms and conditions of entry. In the event there is a dispute concerning the conduct of the Competition, the decision of the Promoter is final and binding on each Eligible Entrant and no correspondence will be entered into.
  22. Eligible Entrants consent to the Promoter and CPA using the Eligible Entrant’s name, likeness, image and/or voice in the event they are a winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this Competition (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter or CPA.
  23. The Promoter and CPA accept no responsibility for any tax liabilities that may arise from winning the prize.
  24. Nothing in these Terms and Conditions restricts, excludes, or modifies any consumer rights under any statute including the Competition and Consumer Act 2010 (Cth).
  25. Subject to the previous paragraph, the Promoter and CPA are not liable (including in negligence) for any loss (including indirect, special or consequential loss or loss of profits), expense, damage, personal injury (including allergies, skin conditions or other reactions, as relevant), illness or death suffered in connection with this Competition or any prize, except for any liability which under statute cannot be excluded (in which case that liability is limited to the greatest extent allowed by law).
  26. Without limiting the previous paragraph, the Promoter and CPA are not liable for any cancellation, loss of, damage to or delay in delivery of prize/s, or for any damage that occurs to displayed prize/s (where relevant).
  27. Travel expenses and other associated costs with claiming the prize(s) are not covered and are the sole responsibility of the winner(s). You must be eligible to travel to where the prize is redeemed, and the Promoter and CPA will not take any responsibility for any travel or entry requirements in any jurisdiction.
  28. These Terms and Conditions shall be governed by the laws of New South Wales and each Eligible Entrant agrees to submit to the non-exclusive jurisdiction of the New South Wales Courts.
